Former Enron chief executive Jeffrey K. Skilling has asked yet another judge to throw out his conviction, citing a recent successful appeal in another-related Enron case by a federal appeals court in New Orleans. Skilling's motion, filed on Tuesday, told Judge Simeon T. Lake III of the U.S. District Court that his conviction should be thrown out because the jury might have relied (ironically) on an "honest services" legal statute -- a theory that is subject to broad or narrow interpretation, and was at the heart of the conviction reversals in New Orleans in August. Many legal experts are saying the statute won't apply to Skilling, reports the Houston Chronicle. Skilling is scheduled for sentencing on Oct. 23.
